1. Agreement to Terms

Welcome to FetaZone ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the FetaZone website, mobile application, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Eligibility and Account Registration

Eligibility

To use FetaZone, you must:

• Be at least 18 years old, or have parental/guardian consent if under 18
• Have the legal capacity to enter into binding agreements
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account

Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and truthful information
• Verify your phone number through our OTP verification process
• Maintain and update your account information as needed
• Notify us immediately of any unauthorized access to your account

3. Use of Service

Permitted Use

You may use our Service to:

• Browse and search for tours, events, and travel experiences
• Book tours, events, and related services
• Create and manage listings (if you are a service provider)
• Communicate with other users through our messaging system
• Leave reviews and ratings for services you have used

Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems (bots, scrapers) to access the Service
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Collect or store personal information about other users without permission
• Circumvent any security measures or payment systems

4. Bookings and Payments

Booking Process

When you book a tour or event through FetaZone:

• You enter into a contract directly with the service provider
• FetaZone acts as an intermediary platform facilitating the transaction
• All bookings are subject to availability and provider confirmation
• You will receive a booking confirmation via email and SMS
• You are responsible for providing accurate booking information

Payment Terms

Payment processing is handled through FenanPay, our secure payment gateway:

• All payments are processed securely through certified payment processors
• We accept various payment methods including Telebirr, CBE Birr and M-Pesa
• Prices are displayed in Ethiopian Birr (ETB) and include applicable taxes
• Payment must be completed before booking confirmation
• Refunds are subject to the cancellation policy of each service provider

Cancellation and Refunds

Cancellation policies vary by service provider:

• Each listing displays its specific cancellation policy
• Refund eligibility depends on the timing of cancellation
• Cancellation fees may apply as specified in the booking terms
• Refunds are processed to the original payment method within 5-10 business days
• FetaZone is not responsible for provider cancellations or changes

5. Service Providers

If you are a service provider (tour operator, event organizer):

• You must complete KYC (Know Your Customer) verification before creating listings
• You are responsible for the accuracy of all information in your listings
• You must honor all confirmed bookings and provide services as described
• You are responsible for obtaining necessary licenses, permits, and insurance
• You agree to comply with all applicable laws and regulations
• FetaZone charges a commission on bookings (as specified in your provider agreement)
• You are responsible for customer service and dispute resolution for your services

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by FetaZone and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you post, but by posting content, you grant FetaZone a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Service.

7. User Content and Reviews

You may post reviews, comments, photos, and other content ("User Content"). You agree that:

• You own or have the right to post the User Content
• User Content is accurate and not misleading
• User Content does not violate any laws or third-party rights
• You will not post spam, offensive, or inappropriate content
• FetaZone reserves the right to remove any User Content that violates these Terms

8. Disclaimers and Limitation of Liability

Service Disclaimer

FetaZone is a platform that connects users with service providers. We do not:

• Own, operate, or control the tours, events, or services listed on our platform
• Guarantee the quality, safety, or availability of any service
• Endorse or recommend any specific service provider
• Assume responsibility for the actions, omissions, or conduct of service providers

Limitation of Liability

To the maximum extent permitted by law:

• FetaZone shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not responsible for any loss or damage resulting from your use of the Service
• Service providers are solely responsible for their services and customer interactions

9. Indemnification

You agree to indemnify, defend, and hold harmless FetaZone, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Request by law enforcement or government authorities
• Extended periods of account inactivity

Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or using account deletion features.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ethiopia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through:

• Good faith negotiation between the parties
• Mediation through a mutually agreed mediator
• Arbitration in accordance with Ethiopian arbitration laws (if negotiation and mediation fail)
• Jurisdiction of the courts of Addis Ababa, Ethiopia

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending you an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
